General Terms and Conditions of Nordic Living GmbH
By placing your order, you accept all points of these General Terms and Conditions, which apply exclusively. Contract conditions that deviate from this are not recognized by Nordish Living GmbH. With an order, the buyer accepts all points of these terms and conditions.
2. Conclusion of contract
All offers are non-binding. If the customer places a verbal, written or electronic order for products, he makes a binding offer to conclude a purchase contract.
A legally binding purchase contract comes about when the order confirmation is sent in writing or electronically by Nordish Living GmbH or when the goods are delivered. If a product is no longer available or deliverable, Nordish Living GmbH can withdraw from the contract in whole or in part without compensation. Payments already made will be refunded.
Nordish Living GmbH is not obliged to accept orders and can withdraw from the concluded purchase contract at any time without any obligation to pay compensation, especially if the customer has outstanding amounts from previous purchases or if his account is debited with debt collection measures. Claims for damages on the part of the customer are excluded. Deliveries and services already provided will be invoiced.
3. Prices and Payment
The prices are in CHF including VAT. Transport, assembly and packaging costs are not included in the price unless other conditions are specified. Nordish Living GmbH reserves the right to adjust prices and/or make price errors at any time. The payment of the order is made by PayPal, credit card, postcard, bank transfer, or in the shop at the checkout. When paying by invoice (COD - immediately before collection/shipping), the customer will be informed by email that his order has been made available. The full amount is due within 7 days thereafter. The customer receives the goods after receipt of payment. An advance payment (when placing the order) is due 7 days after receipt of the order. Orders will only be processed after receipt of payment. After this period has expired, the customer is in default even without a reminder. Nordish Living GmbH is entitled to demand default interest of 5%, unless otherwise agreed. Nordish Living GmbH reserves the right to subject customers who order by invoice to a credit check. In the case of negative or non-verifiable creditworthiness, payment in advance can be requested. Partial payments and other payment terms are possible by agreement. Payment with a Nordish voucher is not possible for SALE items and promotions. Vouchers are valid for 1 year. No further reductions can be applied to SALE items & promotions.
4. Retention of Title
The delivered goods remain the property of Nordish Living GmbH until full payment has been made. The legal process is excluded.
5. Measures and pictures etc.
All dimensions, weights, information and illustrations of our products are non-binding. The description, specifications and prices of the products are subject to change at any time. Model changes, typographical or graphic errors, errors in product descriptions, prices and technical information are reserved.
6. Delivery times
The delivery period begins with the order confirmation. Multiple items from the same order are usually shipped together. For items with different delivery times, the longest applies. However, partial deliveries are possible by agreement. Delivery times are given as precisely as possible. However, these are based on empirical values and are non-binding. Delivery dates may change. Delays in delivery under no circumstances justify claims for damages or a right to withdraw from the contract.
Depending on the item, shipping is by parcel service or furniture carrier. Parcels are usually delivered to the front door, large and bulky furniture to the curb. The shipping methods listed on the website are part of these terms and conditions and apply in full. Not by car/truck, or buildings and places that are difficult to reach (mountain areas) must be agreed and calculated individually. You are excluded from these terms. Please also check in advance whether delivery to your apartment is even possible with two men. If it is not possible to bring the furniture to its destination, for example because the stairwell is too narrow or the lift is too small, we reserve the right to cancel the delivery. Any costs for furniture delivery will also be charged in this case. For deliveries that cannot be transported by 2 men, we reserve the right to charge for the additional costs.
We ship exclusively within Switzerland and Lichtenstein.
Unless otherwise agreed, the shipping of SALE items and promotions is always subject to a fee and is charged either at a fixed price or according to weight and size.
The buyer must inform the transport company and Nordish Living GmbH of any incorrect deliveries and damage caused by transport within 3 days of delivery, including photos via form or to firstname.lastname@example.org. In the event of damage, the goods including the packaging must be kept unused until the case has been dealt with. The defects must be noted on the delivery note upon delivery.
If Nordish Living has not received any notification of incorrect delivery or transport damage within 3 days of delivery, the goods are deemed to have been delivered in perfect condition.
If the item was in stock at the time of ordering, it can be returned within 7 days of receipt in perfect, new condition and in the undamaged original packaging. A receipt or order number must always be included. The item can be returned after notification via Form or email to email@example.com or handed over personally in the shop during opening hours. The addresses can be found on the form.
Excluded from the right of return are: Sale and promotional items, free items, custom-made/ordered items, items that were ordered in large quantities, consumables (example: light bulbs), vouchers.
In the case of returns of parcels and freight forwarding goods, the return is at the expense and risk of the customer. If the goods are in new condition after the return, the value of the goods, minus any delivery costs, will be refunded within 10 days as a voucher or in the payment method stated on the receipt. In the case of returns of items that were delivered by freight forwarders, bulky goods or parcels, any delivery costs will be charged. A refund of delivery costs paid by the buyer is not possible. Rejected returns must be picked up in store.
9. Warranty and Liability
The manufacturer's guarantee provisions apply to the items in our range. The guarantee is provided for defects in material and construction for a period of 24 months from delivery of the goods. It can only be claimed within Switzerland. Any other guarantee is expressly excluded. If the buyer asserts justified defects within the meaning of these provisions, Nordish Living GmbH has the choice of repairing the defects or replacing the defective goods or parts thereof with new ones. If this is not possible, the buyer receives the current value of the goods in the form of a voucher. The duration of the warranty is not renewed or extended by any repairs or replacement deliveries.
All claims must be Form or email to firstname.lastname@example.org with product photos and case description.
A receipt or order number must always be included.
Liability must be examined and acknowledged by Nordish Living for each complaint received. After the claim has been accepted, the buyer can return the defective item to the store during opening hours. Otherwise, Nordish Living can provide return labels. A replacement will be shipped to the buyer upon receipt of the defective item. If the pieces of furniture are larger, you will be informed by email about how to proceed.
The following are excluded from liability:
Further claims by the buyer, including lost profits, consequential damages or other financial losses are expressly excluded within the scope of what is legally permissible.
The warranty is excluded for damage that can be attributed to normal wear and tear or improper use or other fault on the part of the buyer. Furthermore, the warranty is excluded if the customer or third parties have carried out repairs, assembly or changes to the goods.
Nordish Living GmbH rejects any liability for damage caused by the use of the goods to the building fabric (e.g. floor, walls) or to the buyer's furniture. Before use, the buyer must ensure that the product cannot cause any damage.
Normally, no guarantee can be given for the lightfastness of the colors of wood, leather, plastic and certain textile fabrics. Deviations in structure and color are unavoidable for certain materials (wood, marble, leather, textiles, etc.) compared to the specifications and therefore do not justify complaints or warranty claims.
In the case of articles that are antique or made with an antique appearance, the characteristic appearance is reinforced by signs of use. This does not constitute a defect.
We do not provide any guarantee for SALE items and exhibits. We recommend all interested parties to contact us by e-mail, telephone or in person to find out about the exact condition of the object they intend to buy.
Nordish Living GmbH is entitled to change its general terms and conditions at any time by notifying the buyer or by publishing them on the website.
Swiss law applies to these General Terms and Conditions, namely the provisions of the Swiss Code of Obligations.
The place of jurisdiction is the seat of the provider (CH-8004 Zurich).
